i1024 By order of November 9, 1999, the application for leave to appeal was held in abeyance pending the decision in Nawrocki v Macomb County Road Commission (Docket No. 107903), and Evens v Shiawassee County Road Commissioners (Docket No. 109921). On order of the Court, the decision having been issued on July 28, 2000, 463 Mich 143 (2000), the application is again considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration in light of Evens v Shiawassee County Road Commissioners, 463 Mich 143 (2000). We do not retain jurisdiction.
